On July 1, 2026, the DEA filed Notices of Intent to temporarily place 7-hydroxymitragynine (7-OH) above a specified concentration threshold into Schedule I of the Controlled Substances Act, alongside three synthetic derivatives — mitragynine pseudoindoxyl, MGM-15, and MGM-16. Key milestones since:
- July 6, 2026: The notices published in the Federal Register; HHS opened a comment period on the proposed threshold.
- August 26, 2026: The three derivatives (MP, MGM-15, MGM-16) became Schedule I federally, effective immediately. These synthetic compounds do not occur naturally in the kratom leaf, and they are not — and will never be — in our products.
- September 10, 2026: The reopened comment period on the 7-OH threshold closed.
- As of today: No federal temporary order covering thresholded 7-OH itself has taken effect. Botanical kratom products below the proposed threshold remain outside the federal action, and our tablets are formulated to comply with applicable thresholds.
Translation for buyers: concentrated or synthetic 7-OH products are on a clear federal path to control, but the thresholded order remained pending as of this update — while derivative products are already fully controlled. States: where the real patchwork lives
Several states regulate kratom-derived alkaloids independently of the federal government — some with concentration or ratio thresholds, others with outright bans, others with consumer-protection-style frameworks. Because state lists changed multiple times in 2025–2026, we won’t paste a static map here that could be outdated next week:
